18 is the age that’s required in some states, but it ultimately depends on the type of location you live in. They actually are not set by the government but are by the states. Some require you to be 18, others 21, and some may even have some restrictions. We’ll dive into this here.
The Typical Age Requirement
You can buy both hemp and CBD due to the farm bill, and it doesn’t technically have the age restriction to get CBD, and there is no law stating federally what the minimum age is to buy this. The states typically pass the age requirements. Usually, you have to be 21 in some states to make this work, and in other states, just 18 years old.

Some also don’t have age restrictions depending on the type of CBD purchase that’s there. Of course, in order to buy it in all 50 states, it needs to have less than .3% THC, and it must come from the hemp, not the marijuana plant.
The Ones with No Age Restrictions
There are certain states that actually don’t have age restrictions on this. First, is Alabama. You just need to be a medical cannabis user, but there’s no restriction. However, you can’t sell CBD outside of medical usage. Arkansas also doesn’t require a license to get this, but if you want to grow or sell it, you’re going to need a license, and it must be directly derived from the hemp plant.
CBD also is available to get in Arizona regardless of the age, as long as you get something derived from the hemp plant. Iowa is another, and you just need to make sure that it’s hemp plant CBD. There’s no age requirement for that in that case. There are other states with no age restrictions or other types of conditions.

- Maryland
- Texas
- New jersey, provided that you’re in the medical marijuana program
- West Virginia
- Virginia
States where you have to be 18
There are certain states where you need to be 18.
California requires you to be 18 in order to get them, even though currently they’re trying to fully legalize this. Colorado as well, provided there is less than .3% THC. Delaware also allows you to get it so long as you’re over 18, and you’ve got a medical license. You can also get it without a license. Florida also you need to be over 18 to grow, get, and also create some products made from CBD hemp without the license.

Georgia actually has CBD products that are illegal unless you buy it for medical reasons, and you have to be over 18 to get it. Hawaii also requires you to be over 18, but some may require you to be 21. Idaho is the same way. Kansas has CBD only from hemp, and requires no THC within this, and is only medical.
Kentucky you need to be 18 and get a doctor’s notice.
Finally, in Louisiana, you must be over 18, but don’t need a license.
Over 21 states
The only over 21 states that require this are:
- Alaska
- Illinois
- Maine
- Indiana
- Rhode island
- Utah
- Tennessee
This is something that you do have to be mindful of, and really, the answer to this depends on your own personal needs, and the type of condition that you have going on. Some states are a bit more lenient than others, so make sure to keep that in mind, and the differences to get the product.
